Pakistan's Virtual Assets Act 2026 Explained for Builders and Startups
Pakistan's Virtual Assets Act 2026 explained for developers and startups: PVARA's 10 licence types, Section 70 and 19 NOCs, the sandbox and bank access.
Pakistan's Virtual Assets Act 2026 Explained for Builders and StartupsPakistan's Virtual Assets Act 2026 made the Pakistan Virtual Assets Regulatory Authority (PVARA) a permanent statutory regulator in March 2026, and PVARA's licensing regime went live in August 2026 with 10 licence categories. For builders, the key point is this: writing blockchain software is not itself a licensed activity, but offering virtual asset services to the public (exchange, custody, token issuance, transfers and more) now needs a PVARA licence, a sandbox slot or an approved NOC. This guide explains what that means for developers, dev shops and startups.
Key takeaways
- PVARA became a permanent body under the Virtual Assets Act 2026 in March 2026; regulations followed a public consultation from 11 June to 2 July 2026.
- There are 10 licence categories, from exchange and custody to issuance and mining-related services.
- Existing operators had to apply for an NOC under Section 70 by 5 September 2026 or stop operating.
- New businesses can start through the regulatory sandbox or an NOC under Section 19, then apply for a full licence.
- SBP Circular No. 10 of 14 April 2026 lets banks serve PVARA-licensed firms, ending the effective banking block that dated from 2018.
- Software vendors to licensed firms are not automatically licensees, but they inherit their clients' compliance requirements.

What the Virtual Assets Act 2026 does
At a high level, the Act:
- creates PVARA as the dedicated regulator for virtual assets and virtual asset service providers (VASPs),
- makes providing defined virtual asset services without authorisation an offence,
- gives PVARA power to issue regulations on conduct, prudential standards, technology, AML/CFT and customer protection,
- sets transition rules for businesses that were already operating.
Reported requirements for licensees include separating customer assets from the firm's own assets, and not lending or pledging customer holdings without written consent.
This article is a plain-language summary based on public reporting. Always read the Act and PVARA's regulations themselves, and take legal advice for your specific case.
The 10 PVARA licence categories
| # | Category | Typical activity | Example builder work |
|---|---|---|---|
| 1 | Exchange | Matching buy and sell orders | Matching engine, order book UI, surveillance |
| 2 | Custody | Holding assets or keys for clients | Wallet infrastructure, MPC, key management |
| 3 | Broker-dealer | Executing trades for clients | Order routing, best-execution reporting |
| 4 | Advisory | Investment advice on virtual assets | Research tools, suitability checks |
| 5 | Lending and borrowing | Crypto-collateralised loans | Collateral monitoring, liquidation logic |
| 6 | Derivatives | Futures, options and similar products | Risk engines, margin systems |
| 7 | Asset management | Managing portfolios or funds | Portfolio accounting, NAV reporting |
| 8 | Transfer and settlement | Moving assets between parties | Payment rails, remittance integrations |
| 9 | Issuance | Issuing tokens to the public | Token contracts, whitepaper data, reserve dashboards |
| 10 | Mining-related services | Mining and related services | Monitoring, energy reporting, pool software |
Issuance has its own detailed rules for Fiat-Referenced Tokens and Asset-Referenced Tokens, including PKR 300 million minimum capital per category and 100% reserves. TK-02 covers those in depth.
How a new startup enters the market
Path 1: the regulatory sandbox
PVARA launched its sandbox on 20 February 2026. It covers tokenization of real-world assets, stablecoin issuance and payments, cross-border remittances and fiat on/off-ramps, with asset-backed tokens as an early priority. Testing can run up to 18 months, extendable, through four stages: application and scoping, technical review, live testing with limits, and transition to licensing.
To be taken seriously you need a working product, a risk framework, compliance leadership, cybersecurity controls, KYC/AML processes, consumer protection measures and an exit plan for user funds. Applications go to sandbox@pvara.gov.pk. TK-03 is a step-by-step guide.
Path 2: an NOC under Section 19
New businesses can seek an NOC under Section 19 before or around incorporation, then move to a full licence application. This is the route for firms that are ready to operate at scale rather than test.
Path 3: transitional operators (Section 70)
Businesses already serving Pakistani users when the regime started had to apply for an NOC by 5 September 2026. Reporting says continuing to operate without applying is treated as an offence.
What changes with SBP Circular No. 10
Since 2018, banks had been restricted from dealing with virtual currency businesses, which pushed the sector to informal channels. SBP Circular No. 10 of 14 April 2026 allows regulated banks to provide services to PVARA-licensed providers and to open segregated client money accounts.
For builders this matters in two ways:
- Fiat on/off-ramps become possible through licensed firms, which makes payment and remittance products more realistic.
- Reconciliation becomes a product need. Segregated accounts mean daily matching of on-chain balances, internal ledgers and bank statements. That is software someone has to build.
Do developers and dev shops need a licence?
This is the question most builders ask. Based on the categories above, a licence attaches to the service offered to the public, not to the act of writing code. In general:
Usually outside licensing (but check):
- Writing smart contracts, dApps or wallets for a client who is responsible for operating them.
- Teaching, writing tutorials, running hackathons.
- Building analytics, dashboards or developer tools that do not hold or move client assets.
- Open-source libraries.
Likely inside licensing:
- Running an exchange, OTC desk or brokerage for Pakistani users.
- Holding client keys or assets (custody), including "we hold it for you" wallets.
- Issuing tokens to the public, including tokenized gold, property or stablecoins.
- Operating transfer or remittance services using virtual assets.
Grey areas to get advice on:
- Running infrastructure (nodes, relayers, bridges) that moves user funds.
- White-label platforms where you operate the backend for a client.
- Non-custodial apps that still route orders or take fees.
If you are unsure, assume you need advice before launch, not after.
A compliance checklist for builders and startups
Whether you are a licensee or a vendor to one, expect these questions:
| Area | What licensed clients will ask of your software |
|---|---|
| KYC/AML | Identity checks, sanctions screening, transaction monitoring hooks |
| Asset segregation | Clear separation of client and company funds in ledgers and wallets |
| Key management | Who holds keys, how they are backed up, multi-sig or MPC |
| Audit trail | Immutable logs of admin actions and configuration changes |
| Security | Code review, penetration tests, smart contract audits |
| Data protection | Where personal data is stored and who can access it |
| Incident response | How you detect, report and recover from a breach |
| Exit plan | How users get their funds back if the service stops |
Building these features well is a real opportunity. The new licensed firms need compliant-by-design products, and many of them will buy rather than build.
What this means for students and freelancers
- Final year projects that model a compliant exchange onboarding flow, a reserve dashboard or a sandbox-ready prototype are now very relevant.
- Freelancers serving foreign clients are mostly unaffected by licensing for code work, but should still keep payments and tax affairs clean (see BC-08).
- Startups should budget time for the sandbox or NOC process and treat compliance staff as a core hire, not an afterthought.
Next step with Digital Silk Route
Digital Silk Route (DSR) teaches blockchain with the regulatory reality built in. The Blockchain track of the DSR AI & Crypto Academy runs from Beginner to Intermediate to Advanced, and each level ends with a capstone: a usable product such as a compliance-aware dApp, a reserve dashboard or a security review. When it is ready, you can list it on the DSR Marketplace for licensed firms and other builders to find. Learn. Build. Earn.
